Housal Subscription Agreement
Please read this Subscription Agreement before subscribing.
This Subscription Agreement governs your paid Housal subscription, including the subscription plan, price, subscription period, payment, automatic renewal, manual payment, cancellation, payment obligations, suspension, termination, changes to plans and services, and the terms applicable to your subscription.
By selecting I Accept and Subscribe, you confirm that you have read, understood and agreed to this Housal Subscription Agreement.
Your general use of Housal is also governed by the Housal Terms of Service. The handling of personal information is governed by the Housal Privacy Policy, and cookies and similar technologies are governed by the Housal Cookie Policy.
1. The Agreement
This Subscription Agreement is between Housal and the person or legal entity subscribing to a paid Housal subscription.
If you subscribe on behalf of a company, brokerage, agency, developer or other legal entity, you confirm that you are authorised to enter into this agreement on its behalf.
"Housal", "we", "us" and "our" mean Housal. "You", "your" and "Subscriber" mean the person or legal entity subscribing to or using the applicable Housal subscription.
This agreement governs the commercial terms of your Housal subscription.
The Housal Terms of Service govern your general use of Housal. The Housal Privacy Policy governs the processing of personal information. The Housal Cookie Policy governs cookies and similar technologies.
Where there is a conflict concerning the commercial terms of a paid subscription, including its price, subscription period, billing, renewal, cancellation or payment obligations, this Subscription Agreement controls that commercial matter.
2. Your Subscription
A subscription gives you access to the Housal plan and features displayed for that plan when you subscribe.
Depending on the plan, this may include property listings, listing allowances, account features, advertising or visibility features, tools and other services expressly included in the applicable plan.
The applicable plan, price, subscription period, allowances and features displayed to you at the time of subscription form part of your subscription record.
A subscription provides access to Housal features and services. A subscription does not guarantee any commercial result.
Housal does not guarantee:
- any minimum number of leads or enquiries;
- any minimum number of views or clicks;
- any particular listing position;
- any particular search-engine position;
- any sale or rental;
- any transaction;
- any revenue or income;
- any particular return on your subscription;
- or any other commercial outcome.
Your decision to subscribe is based on the features and services Housal makes available, and not on any guaranteed commercial result.
3. Subscription Period
Your subscription begins when Housal receives and accepts the applicable payment, or when Housal activates the subscription following acceptance of an applicable manual payment.
The subscription runs for the period selected by you and displayed by Housal before subscription.
Housal may offer different subscription periods, including monthly, quarterly, semi-annual, annual or other periods.
The applicable subscription period is recorded against your Housal account.
4. Subscription Price
You agree to pay the subscription price displayed by Housal for the plan you select.
Prices are stated in Philippine pesos unless Housal expressly states otherwise.
The price applicable to your subscription is the price displayed by Housal at the applicable time, subject to any specific price-lock commitment expressly provided by Housal.
The subscription price for a subscription period is payable for that period in accordance with this agreement.
Housal may change subscription prices for future subscription periods.
A price change does not alter an amount that has already been paid for a subscription period.
Where applicable law requires Housal to provide notice of a price change, Housal will provide the required notice.
A subscriber is responsible for reviewing the current Housal subscription plans, prices and applicable terms before subscribing or continuing a subscription.
5. Automatic Renewal
Unless Housal expressly states otherwise for a particular plan, a paid subscription renews automatically.
By selecting I Accept and Subscribe, you expressly authorise Housal and the applicable payment processing provider to continue your subscription and process payment for each subsequent subscription period until the subscription is properly cancelled or terminated.
The renewal period is normally the same as the original subscription period.
For example:
- a monthly subscription renews monthly;
- a quarterly subscription renews quarterly;
- a semi-annual subscription renews every six months; and
- an annual subscription renews annually.
The applicable renewal date and renewal price are displayed at checkout where applicable and recorded against your subscription.
The renewal payment becomes due when the current subscription period ends.
Housal may send a renewal reminder as a convenience. A renewal reminder does not create the subscription obligation and is not a condition of renewal.
Failure to receive, read, notice or act upon a renewal reminder does not cancel the subscription and does not extinguish an amount that has become payable.
6. Recurring Payment Authorisation
By selecting I Accept and Subscribe for a recurring subscription, you authorise Housal and its applicable payment processing provider to process:
- the initial subscription payment;
- each subsequent renewal payment;
- any other amount expressly payable under this agreement.
The recurring payment authorisation remains effective while the subscription remains active and until the subscription is properly cancelled or terminated.
Housal does not require a new acceptance from you for every renewal while the subscription remains active and the recurring payment authorisation remains applicable.
You are responsible for keeping your payment method valid, current and capable of processing the applicable payment.
You are also responsible for ensuring that sufficient funds or credit are available when payment becomes due.
Changing, replacing, cancelling or allowing the payment method to expire does not itself cancel the Housal subscription.
7. Failure of Automatic Payment
A failed automatic payment does not constitute cancellation.
If an automatic payment fails, Housal may:
- notify you of the failed payment;
- retry the payment;
- restrict subscription features;
- suspend the subscription;
- unpublish listings;
- restrict publishing or editing;
- restrict advertising or visibility features; or
- take other action permitted under this agreement or the Housal Terms of Service.
Until the subscription is properly cancelled or terminated, any subscription fee that has become due remains payable.
A payment failure does not extinguish the subscription fee.
A payment failure does not create a refund entitlement.
A payment failure is not a cancellation request.
8. Manual Payment
Housal may allow subscribers to pay manually through payment methods made available by Housal, which may include bank transfer, GCash, Maya, InstaPay or another payment method Housal makes available.
A manual payment is not completed merely because you transfer funds or upload proof of payment.
A manual payment becomes effective when Housal has verified and accepted the payment.
The subscription begins or continues from the date and time Housal accepts the applicable payment, subject to the subscription period and amount applicable to that payment.
Manual payment does not create a different type of subscription.
A manually paid subscription remains fully governed by this Subscription Agreement, the Housal Terms of Service, the Housal Privacy Policy and the Housal Cookie Policy.
Manual payment changes only the method by which payment is made. It does not:
- waive any payment obligation;
- reduce any amount payable;
- change the subscription period;
- cancel a subscription;
- create a refund entitlement;
- or otherwise modify this agreement.
If the Subscriber does not properly cancel before a subsequent subscription period begins, the subscription continues for that period and the applicable subscription fee becomes due and payable, regardless of whether payment is made automatically or manually.
A manually paid subscription does not involve an automatic charge to a stored payment method unless Housal expressly provides otherwise.
The difference between an automatic subscription and a manually paid subscription is the method of collection, not the obligation.
- Automatic subscription. Housal charges the payment method associated with the subscription. The subscription obligation exists independently of whether that charge succeeds.
- Manually paid subscription. Housal does not automatically charge the Subscriber. If the Subscriber does not properly cancel, the next subscription period becomes payable and Housal may demand payment of it.
A manually paid subscription is not a prepaid commitment that expires without further obligation. Unless the Subscriber properly cancels before the commencement of the next subscription period, the subscription continues into that period and the applicable subscription fee for that period becomes due and payable. Housal may demand payment of that amount notwithstanding that the Subscriber did not make an advance manual payment for that period.
9. Payment Obligation Following Renewal
If you do not properly cancel your subscription before the applicable renewal date, the subscription continues into the next subscription period and the subscription fee for that period becomes due and payable.
This payment obligation applies regardless of whether:
- automatic payment succeeded;
- automatic payment failed;
- you subsequently make payment manually;
- you received or did not receive a reminder;
- you read or did not read a reminder;
- you noticed or did not notice the renewal;
- you intended or did not intend to continue using Housal;
- you published or did not publish listings;
- you received or did not receive enquiries;
- you used or did not use Housal;
- you logged in or did not log in;
- you changed your payment method;
- or you changed your business plans or circumstances.
Non-use is not cancellation.
Payment failure is not cancellation.
Silence is not cancellation.
Failure to log in is not cancellation.
Changing or removing a payment method is not cancellation.
The subscription must be cancelled using the cancellation method made available by Housal.
Where a subscription has renewed and the applicable renewal payment has not been successfully collected, the renewal remains valid and the renewal amount remains due and payable. The Subscriber's obligation to pay is not extinguished by the failure of an automatic payment, and Housal may require the Subscriber to settle the outstanding amount through a manual payment method or another payment method made available by Housal.
The Subscriber may not treat the failure, rejection, reversal, expiration or removal of a payment method as cancellation of the subscription.
Once a subscription period has begun and its fee has become due, that payment obligation remains payable unless Housal expressly agrees otherwise in writing or applicable law requires otherwise.
10. Cancellation
You may cancel your subscription using the cancellation method Housal makes available.
Housal may provide cancellation through your Housal account, account settings, the Housal Message Box or another method Housal designates.
Cancellation takes effect when successfully submitted and recorded by Housal.
Cancellation prevents future renewal after the effective cancellation.
Cancellation does not cancel, reverse, reduce or extinguish any amount that became payable before cancellation took effect.
If you cancel after a subscription has already renewed, the renewed subscription period remains subject to its payment obligation.
Cancellation does not create a refund entitlement.
11. No Refunds
All Housal subscription payments are final and non-refundable.
Housal does not provide refunds for:
- unused subscription time;
- partial subscription periods;
- non-use of Housal;
- failure to publish listings;
- failure to receive leads or enquiries;
- failure to receive a sale or rental;
- failure to receive a commercial result;
- a change in business plans;
- a change in personal or business circumstances;
- an accidental subscription;
- forgetting to cancel;
- failing to cancel before renewal;
- failing to notice a renewal;
- changing your mind;
- an unsuccessful cancellation attempt;
- unused listing allowances;
- unused features;
- unused advertising or visibility benefits;
- payment of a subscription period that has already begun; or
- any other reason arising from the Subscriber's decision not to use the subscription.
A subscription that has renewed before cancellation remains payable and is not refundable merely because the Subscriber subsequently cancels.
Housal does not provide a money-back guarantee.
Housal does not provide a discretionary refund merely because a Subscriber requests one.
Nothing in this section is intended to exclude or limit a right or remedy that applicable Philippine law does not permit Housal to exclude or limit.
12. No Waiver or Reduction of Payment Obligations
No employee, salesperson, broker, agent, representative or other person may waive, reduce, cancel, forgive, defer or otherwise modify an amount payable under this agreement unless that person has express authority from Housal to do so and the modification is confirmed by Housal in writing.
A statement made by a person who is not authorised by Housal does not modify this agreement.
Housal's failure to immediately demand payment does not waive the payment obligation.
A delay in requesting payment does not reduce the amount payable.
A payment reminder does not create a new obligation and does not replace the original obligation.
Acceptance of a partial payment does not constitute acceptance of the partial amount as full settlement unless Housal expressly confirms otherwise in writing.
13. Payment Processing
Housal may use payment providers and payment infrastructure to process subscription payments.
Payment providers process payments on behalf of the applicable transaction and are not parties to this Subscription Agreement.
Your use of a particular payment method may also be subject to the applicable payment provider's own terms and conditions.
A payment provider's processing failure does not by itself:
- cancel your subscription;
- extinguish an amount payable to Housal;
- create a refund entitlement; or
- modify this agreement.
Housal does not control the internal systems, policies or availability of third-party payment providers.
14. Taxes, Bank Charges and Processing Charges
You are responsible for taxes, duties, bank charges, payment-provider charges and similar amounts properly chargeable to you in connection with your subscription or payment, where applicable.
Housal may display applicable taxes or charges separately where required or appropriate.
15. Changing Your Subscription Plan
Housal may offer different subscription plans.
If Housal allows you to change your plan, the applicable price, features, allowances and effective date of the change will be displayed before the change is confirmed where appropriate.
Unless Housal expressly states otherwise, changing plans does not create a refund or credit for amounts already paid.
Unused time, listing allowances, features or other subscription benefits do not automatically create a credit or refund.
Housal may apply different rules to upgrades, downgrades, plan migrations or discontinued plans and will display the applicable terms where relevant.
16. Subscription Features, Services and Limits
The features, services, allowances and limitations applicable to your subscription are those displayed by Housal for the applicable plan.
Housal may introduce, modify, replace, suspend or discontinue:
- subscription plans;
- features;
- services;
- listing allowances;
- advertising functions;
- visibility functions;
- tools;
- account functions;
- technologies;
- integrations;
- support channels; and
- other components of Housal.
Housal may make such changes for operational, commercial, technical, security, legal, regulatory, development or other reasons.
Housal does not guarantee that a particular feature, service or function will remain permanently available unless Housal has expressly committed to its continued availability in writing.
A change to a feature or service does not automatically create a refund or credit.
17. Listings and Subscriber Content
A subscription does not transfer ownership of your property information, photographs, documents or other content to Housal.
Your rights and obligations concerning content uploaded to Housal are governed by the Housal Terms of Service.
A subscription does not give you authority to advertise property that you do not have the legal right or authority to advertise.
You remain responsible for:
- the accuracy of your listings;
- the legality of your listings;
- your authority to advertise each property;
- the accuracy of property information;
- the rights associated with photographs and documents;
- and compliance with the Housal Terms of Service.
18. Housal Communication and Message Box
Housal may provide communication between registered Housal users through the Housal Message Box or other communication functionality provided by Housal.
Where the Housal Message Box is provided, it may serve as the primary communication and record system for inquiries and conversations conducted through Housal.
Notifications concerning a message may be delivered by email, push notification or another notification method. A notification is not necessarily the conversation itself.
The Housal Message Box, including its rules, permitted uses, prohibited conduct, moderation, anti-circumvention measures, verification requirements and enforcement, is governed by the Housal Terms of Service.
The Housal Message Box does not create an obligation for Housal to guarantee that any subscriber receives an enquiry, response, lead or transaction.
19. Suspension for Non-Payment
Housal may suspend a subscription where an amount due remains unpaid.
During suspension, Housal may:
- restrict access to subscription features;
- restrict publishing or editing;
- unpublish listings;
- restrict advertising functionality;
- restrict visibility benefits;
- restrict other subscription benefits; and
- take other action permitted by Housal.
Suspension does not extinguish the amount owed.
Payment of an outstanding amount may allow Housal to restore the subscription, subject to Housal's procedures and any other outstanding issue.
Suspension for non-payment does not constitute cancellation.
20. Suspension or Termination for Breach
Housal may suspend or terminate a subscription where the Subscriber breaches this agreement, the Housal Terms of Service or applicable law.
This may include:
- fraudulent activity;
- misleading or false listings;
- advertising property without authority;
- impersonation;
- misuse of another person's information;
- abusive conduct;
- prohibited communications;
- attempts to circumvent Housal systems;
- attempts to move Housal transactions or communications outside Housal contrary to Housal rules;
- payment fraud;
- repeated payment disputes;
- misuse of Housal;
- or other serious or repeated violations.
Where Housal terminates a subscription for breach, termination does not create a refund entitlement and does not extinguish amounts that became payable before termination.
Housal may also take other enforcement action available under the Housal Terms of Service.
21. Changes to Housal Documents, Plans, Prices and Services
Housal may at any time update, amend, modify, replace, supplement or otherwise change:
- this Subscription Agreement;
- the Housal Terms of Service;
- the Housal Privacy Policy;
- the Housal Cookie Policy;
- Housal subscription plans;
- subscription prices;
- subscription periods;
- features;
- services;
- listing allowances;
- requirements;
- procedures;
- technologies;
- communication systems;
- verification requirements;
- payment methods;
- account functions; and
- other aspects of Housal.
Housal may make changes for any reason, including changes to Housal's business, services, technology, security, operations, pricing, plans, features, legal requirements or regulatory requirements.
The current version of each Housal document is made available by Housal through the applicable Housal website, account area or other Housal channel.
Each document may carry its own version number and effective date.
Housal may retain previous versions for its records.
You are responsible for keeping yourself informed of the current Housal documents, subscription plans, prices, features, services, requirements and procedures.
You should review the applicable Housal information from time to time and before:
- subscribing;
- renewing;
- changing a subscription;
- continuing to use a Housal service; or
- entering into a new transaction with Housal.
Where applicable law requires Housal to provide notice of a particular change or obtain acceptance of a particular change, Housal will provide the required notice or obtain the required acceptance.
Except where applicable law requires otherwise, Housal is not required to obtain fresh individual acceptance every time an Housal document is updated.
To the extent permitted by applicable law, continued use of Housal after the effective date of an updated version of this Subscription Agreement or the Housal Terms of Service constitutes acceptance of that updated version.
The Housal Privacy Policy and the Housal Cookie Policy are not commercial contracts and are not updated on that basis. They are updated in accordance with their own subject matter and applicable Philippine data protection law, including the transparency and information requirements that apply to the processing of personal information. Where that law requires a particular form of notice, information or consent, Housal follows it.
If you do not agree with an updated document, you are responsible for discontinuing the relevant use of Housal or cancelling the relevant subscription or service using the applicable cancellation method.
Housal may introduce new plans and may discontinue plans that are no longer offered.
The applicable plan and price are the plan and price displayed by Housal at the time applicable to the relevant subscription or renewal, subject to any specific price-lock commitment expressly provided by Housal.
Housal may publish updated information through:
- the Housal website;
- subscription pages;
- your Housal account;
- the Housal Message Box;
- notices;
- or another appropriate Housal channel.
A change to the price does not retrospectively alter an amount already paid for a completed subscription period.
A price applicable to a future subscription period may be different from the price applicable to an earlier period.
22. Electronic Acceptance and Subscription Record
Your electronic acceptance of this agreement is intended to create a binding agreement between you and Housal.
By selecting I Accept and Subscribe, you confirm that:
- you had the opportunity to read this agreement;
- you understand that the subscription is paid;
- you understand the applicable subscription period;
- you understand the applicable subscription price;
- you understand whether the subscription renews automatically;
- you understand the applicable recurring payment authorisation;
- you understand that payment obligations continue until proper cancellation or termination;
- you understand that subscription payments are non-refundable; and
- you agree to be bound by this agreement.
Housal records the applicable subscription acceptance information so that Housal can establish what subscription terms were presented and accepted.
The record may include:

Housal may make the applicable subscription record available through the Subscriber's account or through another Housal process.
23. Relationship with the Housal Terms of Service and Other Documents
This Subscription Agreement forms part of the contractual relationship between you and Housal.
The Housal Terms of Service govern general use of Housal.
The Housal Privacy Policy governs the processing of personal information.
The Housal Cookie Policy governs cookies and similar technologies.
This Subscription Agreement governs the commercial terms of your paid subscription.
Where there is a conflict concerning a commercial subscription matter, this Subscription Agreement controls that matter.
Nothing in this agreement is intended to remove or limit an obligation or right that applicable Philippine law does not permit Housal to remove or limit.
24. Governing Law
This agreement is governed by the laws of the Republic of the Philippines.
Disputes concerning this agreement are subject to the jurisdiction of the competent courts of the Republic of the Philippines, subject to any mandatory rights, remedies or jurisdictional requirements under applicable law.
Before commencing proceedings, you may use the communication method Housal makes available to raise the matter directly with Housal.
25. Severability
If any provision of this agreement is found to be invalid, illegal or unenforceable, that provision will be interpreted or limited to the extent necessary to make it enforceable where legally permitted.
If the provision cannot be made enforceable, it will be treated as severed to the extent necessary, and the remaining provisions will continue in effect.
26. Entire Subscription Agreement
This Subscription Agreement constitutes the agreement between you and Housal concerning the commercial terms of your paid subscription.
It supersedes prior statements or representations concerning the commercial terms of the subscription to the extent those statements or representations conflict with this agreement.
No statement made by a salesperson, employee, broker, agent or other person may create a different subscription obligation, payment term, refund entitlement, waiver, cancellation right, discount or exception unless expressly authorised by Housal.
The Housal Terms of Service, Housal Privacy Policy and Housal Cookie Policy remain applicable to their respective subject matters.
27. Acceptance
By selecting I Accept and Subscribe, you confirm that you have read, understood and agreed to this Housal Subscription Agreement.
Your acceptance applies to the version presented to you at the time of acceptance.
